Terms and conditions

ACCEPTANCE

The acceptance of any quote must be made via email, instant messaging, or other written communication systems. Acceptance of a quote implies acceptance of the price, quantities, and the terms and conditions of CACTUS SENY GRÀFIC®. The payment of the first installment will serve as the start order for the commissioned work. In cases where it is specified that the quote will be paid upon completion of development, acceptance of the quote will be considered the start order for the commissioned work. Once the quote is accepted, the client commits to carrying out the project. If for reasons beyond the control of CACTUS SENY GRÀFIC® the project is not finalized, the CLIENT will lose the right to claim the amounts invoiced based on the order set out in the quote.

VALIDITY OF QUOTES

Our quotes are valid for 3 months. After 3 months from the issuance of the quote, and without its acceptance, CACTUS SENY GRÀFIC® reserves the right to make changes to this quote (modifying prices, concepts, or any value at the discretion of CACTUS SENY GRÀFIC®).

TAXES

Our economic proposals DO NOT INCLUDE Value Added Tax (I.V.A.) or other taxes such as Personal Income Tax (I.R.P.F.). Our quotes cannot be considered a proforma invoice.

ELEMENTS AND TASKS NOT INCLUDED

Our quotes do not include additional work that may arise from changes in direction by the CLIENT. Our quotes also do not include additional work or non-indicated additional costs (such as the acquisition of specific tools or software). Should this case arise, a new agreement must be reached to modify this quote.

LICENSES

Our quotes do not include the acquisition of materials, software, graphic resources, plugins, themes, or other tools necessary for the development of the activities described in this quote. CACTUS SENY GRÀFIC® will make available to the CLIENT, in good faith, all tools, materials, software, graphic resources, plugins, or templates already in its possession to avoid increasing the cost of the activities described in this quote as much as possible.

Nevertheless, CACTUS SENY GRÀFIC® reserves the right to cancel or modify the licenses of themes, plugins, graphic resources, materials, or software active in projects already delivered without prior notice to the CLIENT. Should this case arise, the CLIENT must assume the costs derived from the acquisition of the themes, plugins, graphic resources, materials, or software under their own responsibility.

MATERIALS PROVIDED BY THE CLIENT

For the correct development of the requested orders, CACTUS SENY GRÀFIC® usually requests materials from the CLIENT, whether texts, images, graphics, or documentation of any kind. CACTUS SENY GRÀFIC® is not responsible for the validity of the materials provided by the CLIENT and will always consider that the CLIENT holds the authorship and/or usage rights of the materials provided, leaving CACTUS SENY GRÀFIC® exempt from any responsibility regarding usage, image, and distribution rights of the materials provided by the CLIENT.

CACTUS SENY GRÀFIC® will not be responsible for the review and/or correction of texts provided by the CLIENT. In the event that CACTUS SENY GRÀFIC® is responsible for the creation of texts, the CLIENT will be required to review and/or correct them and provide final approval.

DELIVERY OF THE ORDER

All materials presented to the CLIENT in relation to the commissioned work must be confirmed by the CLIENT: that they are correct and satisfy the interest for which CACTUS SENY GRÀFIC® was hired, leaving CACTUS SENY GRÀFIC® free from any responsibility for errors or defects that may exist and that have not been subject to a claim prior to the completion and delivery of the work to the CLIENT.

The order (total or partial) will be considered finished once the actions described in this quote have been carried out and invoiced. After invoicing, the CLIENT has 30 calendar days for the total and complete review of the order, during which they may request changes or corrections. CACTUS SENY GRÀFIC® will perform these changes and corrections whenever possible and provided they are included within the framework of this quote (see "Elements not included" for more information).

Once the 30-day period after invoicing has ended, the CLIENT will lose the right to request changes or corrections within the framework of this quote. CACTUS SENY GRÀFIC® may provide a new quote for these changes or corrections.

PAYMENT CONDITIONS OF THE ORDER

With the acceptance of a quote by the CLIENT, it will be considered that the payment conditions set out in the same quote are accepted. CACTUS SENY GRÀFIC® will invoice the requested orders following the payment conditions set out in this quote. In case of non-payment of invoices, and after 15 days from their due date, CACTUS SENY GRÀFIC® reserves the right to withdraw the services provided, potentially deactivating them or preventing their use, until the CLIENT settles the unpaid invoice(s).

SUBSIDIES, GRANTS, OR DIGITAL KITS

In the event that the web design and development project is carried out within the framework of a subsidy, grant, or Digital Kit, CACTUS SENY GRÀFIC® commits to collaborating to facilitate the development of the project within the frameworks of the subsidy, grant, or Digital Kit in question. However, it is important to understand that the awarding of these subsidies, grants, or Digital Kits is subject to external criteria and approvals that are beyond the control of CACTUS SENY GRÀFIC®.

In the unlikely scenario that the subsidy, grant, or Digital Kit cannot be applied to the project for reasons beyond our control (delivery deadlines, documentation associated with the client, etc.), CACTUS SENY GRÀFIC® will not assume any responsibility for the costs associated with the project. In this case, the client commits to assuming full payment of the project fees and costs, regardless of whether the subsidy, grant, or Digital Kit has been obtained.

It is the client's responsibility to evaluate the risks associated with obtaining and applying for subsidies, grants, or Digital Kits, as well as to be prepared to cover the total costs in the event that the planned external financing does not materialize. CACTUS SENY GRÀFIC® will continue to provide its web design and development services in accordance with the agreed terms and conditions, regardless of the outcome of the subsidy, grant, or Digital Kit application.
